Definitions

“The Agency” – Mass Movement Agency & Casting Ltd.

“The Artist” – the named party employed to carry out services contracted by “The Agency” on behalf of “The Client” in relation to the brief set out by “The Client” and “The Agency”.

“The Client” – a third party requiring the services of “The Agency” to contract “The Artist”.

“The Project” – any undertaking of services supplied by “The Agency” that require the unique skillsets provided by “the artist”

“Booking Confirmation Form” – Binding contract of terms and conditions relating to “the project”.

“Remuneration” – often also cited “fee”, “fees” or “rates” is the agreed monetary value between “The Agency” and “The Client” on behalf of “The Artist” in relation to the services provided to “The Project”.

“Call Time” – the time at which “The Artist” commences their contracted working hours as outlined in the “Booking Confirmation Form”.

“Finish Time” – also “wrap time” is the time at which “The Artist” ends their contractual obligation of working hours as outlined in the “Booking Confirmation Form”.

“Reasonable Working Hours” – between the hours of 08:00 and 23:00.

“Period of Engagement” – the hours by which “The Artist” is contracted to provide their services for.

 

  1. BOOKINGS

    “The Artist” will receive a “Booking Confirmation Form” that serves as the agreement between “The Artist” and “The Agency” on behalf of “The Client” to deliver the required services as outlined in the terms and conditions of the “Booking Confirmation”. This is provided on a project-by-project basis and unique only to “The Project” dictated by the “Booking Confirmation” and may contain unique terms and conditions that override/update the “Agency Terms and Conditions.”

    Each “Booking Confirmation Form” must be signed and return by “the artist” in order to secure the terms and conditions. “The Agency” is unable to enforce the terms and conditions outlined the “Booking Confirmation Form” until it is returned fully signed. This also relates to “remuneration” against “the project”.

    The signed “Booking Confirmation Form” together with the “Agency Terms and Conditions” shall form the binding agreement between “The Client” and “The Agency” unique to “The Project.” All or any amendments of said terms and conditions expressed by “The Client” are not binding unless “The Agency” has agreed the amendments by an authorised representative of “The Agency.”

  2. REMUNERATION

    The agreed contractual value of “The Project” will be provided in the “Booking Confirmation Form”. This will be based on rates agreed between “The Agency” and “The Client” on behalf of “The Artist” and, where possible, will be itemised on the “Booking Confirmation Form”. Unless otherwise stated on the “Booking Confirmation Form”, rates are based on the following:

    1. Rehearsal rate: a single day consisting of up to 8 hours or a half day of up to 4 hours.
    2. Technical/Onsite/Dress rehearsal rate: a single day consisting of up to 10 hours
    3. Show/Performance Rate: a single day to include the scheduled performance. A day will consist of up to 10 hours.
    4. Shoot rate: a single day consisting of up to 10 hours.
    5. Usage Buyout: a one-off fee in addition to the rates to cover the permitted use of any recorded media obtained during the performance or shoot to be negotiated by “The Agent” based on the terms agreed between “The Agency” and “The Client.”
    6. Overtime: chargeable at 20% of the daily rate after the scheduled hours outlined in the “Booking Confirmation Form.”
    7. Fitting rate: if the fitting occurs on a separate day to the scheduled rehearsals, an individual rate of £50 per hour, unless otherwise pre-agreed, will be payable to “the artist”.
    8. Wardrobe, Hair & Make-Up: “The Artist” is to be compensated for provision of own clothes for a shoot or performance at a rate of £50 per outfit or £25.00 per item. If hair and make-up is requested by “The Client” or parties otherwise related to “The Project”, then sufficient expenses will be reimbursed by “The Client”.
  3. CREDITS

    “The Client” agrees to include a credit in the form of the name of “The Artist” and “The Agency” where a credit is applied.

  4. TRANSPORTATION

    Where the venue provided by the “The Client”, and which requires the attendance of “The Artist”, is outside of London and/or cannot be travelled to using the Transport for London network, “The Client” agrees to supply transport or reimbursement for expenses incurred by “The Artist” to travel to said venue.

    “The Client” will also cover expenses toward transport where the “Call Time” and/or “Finish Time” for “The Artist” is beyond the scope of “Reasonable Working Hours”.

  5. ACCOMMODATION

    When required and where possible, “The Client” will seek to provide single room occupancy for “The Artist” on any projects that fall outside of London.

  6. EXPENSES

    All food provisions/per diems, travel and accommodation are to be provided at the expense of the client where applicable. Requirements for expenses are agreed on a project-by-project basis. Where per diems are allocated to “The Artist”, they must be provided in advance of travel. Any agreed expenses incurred by “The Artist” or “The Agency” is to be reimbursed immediately.

    Where “The Agent” agrees to organise or pay “The Artist” expenses without having first been reimbursed by “The Client”, a minimum surcharge of 7.5% will be added to each item due for reimbursement.

  7. MEALS

    “The Client” is responsible for the provision of meals, beverages and refreshments during the “Period of Engagement” with consideration to the dietary requirements of “The Artist”.

  8. CANCELLATION POLICY

    If “The Artist” cancels or breaks the terms and conditions of the “Booking Confirmation Form” for whatever reason, “The Artist” is accountable for all financial losses and costs associated to the expenses incurred in replacing them.

    Where “The Client” cancels the booking, an applicable fee will be paid to “The Agency” on behalf of “The Client”, this is determined when the cancellation is received and acknowledged by “The Agency” as follows:

    1. Where the cancellation is received and acknowledged one working day prior to the “period of engagement” commencing, “The Client” is liable to pay 100% of the full contractual fee.
    2. Where the cancellation is received and acknowledged two working days prior to the “period of engagement” commencing, “The Client” is liable to pay 50% of the full contractual fee.
    3. Where the cancellation is received and acknowledged within a period in equal length to the number of working days contracted in the “Booking Confirmation Form”, then “The Client” is liable to pay 100% of the contractual fee.
  9. ARTIST PORTRAYAL

    Photographic Stills and Video that require “The Artist” to appear nude, semi-nude or in revealing attire, including swim suit and lingerie, must have the express prior written consent of “The Agency.” Usage of such material must not be directly or indirectly scandalous, pornographic or derogatory and cannot be altered and distorted to portray anything other than what was intended ad agreed.

  10. ARTIST WELL-BEING

    “The Client” shall be solely responsible for ensuring the talent is treated with respect and professionalism, and that all necessary steps are taken to ensure the safety, health and wellbeing of the talent is protected, at all times by “The Client” and/or any third parties engaged by “The Client” in relation to the delivery of the services, with specific attention to:

    1. Ensuring that the venue for the provision of the services and the working conditions are entirely safe and secure and maintained at a suitable temperature and allow “The Artist” to provide the services in compliance with all health and safety best practice, standards, regulations, codes and laws.
    2. Allowing “The Artist” suitable and regular rest periods to ensure they are able to maintain a suitable physical standard through rest and refreshment whilst delivering the services.
    3. Ensuring that all third parties engaged by “The Client” in relation to “The Project” and delivery of the services are suitably qualified, experienced and professional.
    4. Ensuring that no one imposes upon “The Artist” any action, activity or environment which is either dangerous, degrading, unprofessional, unsafe and/or demeaning to the talent.
    5. Providing “The Artist” with an appropriate changing and dressing area where they can prepare for the provision of the services and also maintains privacy.
